1.) Enforce Payment Rights under California Law

When asked to elaborate, she explained, “A lot of my clients are unaware of laws in the state of California that were enacted specifically to protect contractors and the construction industry, particularly when it comes to payment rights and late payments.”

In other words, Carno said, the construction industry has certain protections under the law that are not provided to other industries.

“These protections include enforcement vehicles for collecting payment which include things like a mechanic’s lien, filing the stop motion, and asserting claims against a payment bond,” she said.

2.) Enforce Payment Provisions of Their Contract

To ensure that the client’s contract is honored Carno files a lawsuit after recording a mechanic’s lien, both of which she says are time sensitive.

The key here is time.

“It’s important for my clients to know that there is a time limit when it comes to recording a lien, and they must file a lawsuit within 90 days of issuing said lien,” Carno explained.

3.) Payment Collection and Legal Fees

One of the things that Carno mentions is a problem in the process of getting unpaid contracts settled is the fact that many potential clients don’t seek her help due to concerns over legal fees.

When asked to comment Ms. Carno said, “Due to my specific focus on this area of law, after filing a lawsuit, the last phase of collecting the payment owed can often be expedited through either a quick settlement or litigation.”

“The reason for this is due to my knowledge of various statutes that pertain specifically to collection efforts, my clients can expect reduced legal fees. In other words they can rest assured that their cases will be handled efficiently and economically,” she said.
